Vessarium Terms of Service
Last updated: [DATE]
These terms govern your use of vessarium.com and any purchase you make from us. By placing an order, you agree to them.
1. Who we are
Vessarium (Pty) Ltd
Registration number: 2026/293538/07
Pretoria, South Africa
studio@vessarium.com
"We", "us", "Vessarium". "You" means the customer.
2. Our products
Vessarium produces hand-finished custom resin collectibles across the Immortalised Edition and League Edition. Every piece is made to order and finished by hand. Minor variation between pieces is inherent to the process, not a defect.
League Edition pieces are limited to 100 units per warrior per size, globally. Once an edition sells out, it will not be reproduced.
3. Orders and acceptance
Placing an order is an offer to buy. A contract forms only when we confirm your order by email. We may decline or cancel any order — including for pricing errors, stock issues, suspected fraud, or unsuitable source material — and will refund you in full if we do.
4. Pricing and payment
Prices are displayed in your local currency where we support it, based on your location. The currency shown at checkout is the currency you will be charged in.
Where a currency other than South African Rand is displayed, the price is converted from our base ZAR price using prevailing exchange rates and may include a conversion fee. Rates fluctuate, so displayed prices in your currency may change from day to day.
Your bank or card issuer may apply its own conversion or foreign transaction fees, which are outside our control and are not included in the total you see at checkout.
Prices include VAT where applicable. Import duties, customs charges, and local taxes on international orders are your responsibility and are not included unless expressly stated at checkout.
Shipping is calculated at checkout. Payment is taken in full at the time of order.
We reserve the right to change prices at any time; changes do not affect orders already confirmed.
5. Custom pieces: your photos and the render approval
For Immortalised Edition pieces you upload a source photograph. By uploading it, you confirm that:
- You own the photo or have permission to use it
- You have permission from every identifiable person in it (or are their parent/guardian)
- The image does not infringe anyone's copyright, trademark, or personality rights
- The subject is not a public figure, licensed character, or third-party IP
You grant us a licence to use the image for the sole purpose of producing your piece. We do not sell, license, or share your source photos with third parties.
We may decline any image — including copyrighted characters, offensive content, or images we can't work from technically — and will refund you.
You will receive a render for approval before production. Approval is the point of no return: production begins, the order becomes final, and the approved render is the reference standard against which the finished piece is judged.
6. Marketing use
We may photograph finished pieces and use those photographs in our marketing. We will not publish your source photograph or identify you without your consent. Email studio@vessarium.com to opt out.
7. Intellectual property
All Vessarium brand assets, sculpts, designs, warrior characters, the League and Founders Series IP, and all site content belong to Vessarium (Pty) Ltd.
Buying a piece buys you the physical object. It does not transfer any rights in the design or sculpt. You may not copy, 3D-scan, mould, cast, reproduce, or reverse-engineer any Vessarium piece, or manufacture derivative works from it, for any purpose.
For custom pieces: you retain rights in your source photograph. We retain all rights in the sculpt, render, and design we create from it.
8. Shipping and risk
Delivery estimates are estimates, not guarantees — production times vary with queue and complexity. Risk passes to you on delivery. Import duties and customs charges on international orders are your responsibility.
9. Returns
Custom and made-to-order pieces are not eligible for change-of-mind returns. Damaged, defective, or incorrect items are covered. See our Returns & Refunds Policy, which forms part of these terms.
10. Our giving commitment
Vessarium donates 10% of profits to people in need. This is a commitment we make voluntarily and is not a term of sale, a charitable trust, or an enforceable obligation to any customer or third party.
11. Acceptable use
Don't use the site to break the law, infringe rights, upload malicious code, scrape our content, or interfere with the site's operation. We may suspend or refuse service to anyone who does.
12. Liability
We do not exclude liability for death, personal injury, fraud, or anything else that cannot lawfully be excluded under South African law, including your rights under the Consumer Protection Act.
Subject to that: we are not liable for indirect, incidental, or consequential loss, or for loss of profit, data, or opportunity. Our total liability for any order is capped at the amount you paid for it.
13. Privacy
We process personal information in line with POPIA and our Privacy Policy.
14. Changes to these terms
We may update these terms. The version in force is the one published on the site when you place your order.
15. Governing law
These terms are governed by the laws of South Africa. Disputes are subject to the exclusive jurisdiction of the South African courts. Nothing here limits your right to approach the National Consumer Commission or a consumer tribunal.
